Cette \u00e9tape permet par ailleurs d\u2019am\u00e9liorer la qualit\u00e9 des offres.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">Dans les limites du principe d\u2019\u00e9galit\u00e9, il est donc tr\u00e8s utile \u00e0 l\u2019adjudicateur d\u2019\u00eatre attentif \u00e0 la mani\u00e8re de communiquer pendant le processus de n\u00e9gociation. Pensons notamment \u00e0 la possibilit\u00e9 d\u2019envoyer les informations utiles par e-mail \u00e0 tous les soumissionnaires \u00e0 la fois. Chaque soumissionnaire re\u00e7oit donc les m\u00eames informations au m\u00eame moment. Veillez toutefois \u00e0 ce que les adresses \u00e9lectroniques des soumissionnaires figurent toujours en copie cach\u00e9e afin de garantir le respect du principe de confidentialit\u00e9.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">En cas de n\u00e9gociations orales, il sera judicieux d\u2019\u00e9tablir au pr\u00e9alable un cadre de discussion. Pensez aussi \u00e0 r\u00e9diger, apr\u00e8s chaque entretien, le compte rendu des points discut\u00e9s, de mani\u00e8re \u00e0 pouvoir en informer tous les soumissionnaires.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">L\u2019adjudicateur ne peut pas d\u00e9cider non plus de n\u00e9gocier avec certains soumissionnaires seulement. Les proc\u00e9dures de n\u00e9gociations pr\u00e9voient toutefois la possibilit\u00e9 de recourir \u00e0 la s\u00e9lection par \u00e9tapes. Celle-ci consiste \u00e0 s\u00e9lectionner, sur la base de crit\u00e8res de prix et d\u2019attribution, les soumissionnaires avec lesquels des n\u00e9gociations seront engag\u00e9es.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">Il est toutefois possible, sur la base d\u2019une s\u00e9lection par \u00e9tapes, d\u2019op\u00e9rer un premier tri fond\u00e9 sur les crit\u00e8res de prix et d\u2019attribution. Cette option n\u2019est \u00e9videmment possible que si le nombre de soumissionnaires est suffisant. Selon la r\u00e8gle de trois, il est recommand\u00e9 d\u2019engager toujours les n\u00e9gociations avec au moins trois soumissionnaires. En admettant qu\u2019il y ait par exemple cinq soumissionnaires en tout, il peut \u00eatre int\u00e9ressant de recourir \u00e0 la s\u00e9lection par \u00e9tapes pour placer temporairement en \u00ab\u202fsalle d\u2019attente\u202f\u00bb les deux soumissionnaires qui satisfont le moins aux crit\u00e8res.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">Enfin, il est bien entendu tr\u00e8s important aussi de veiller scrupuleusement \u00e0 la confidentialit\u00e9 des offres. En vertu du principe de confidentialit\u00e9, il est en effet interdit de partager les informations confidentielles des soumissionnaires. Une exception \u00e0 cette r\u00e8gle est possible d\u00e8s lors que le soumissionnaire a donn\u00e9 son accord pr\u00e9alable par \u00e9crit. La pratique nous montre toutefois que lorsqu\u2019il s\u2019agit v\u00e9ritablement d\u2019informations confidentielles, le soumissionnaire ne donnera bien s\u00fbr jamais son accord.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p><h3><b><span data-contrast=\"auto\">Conseils pour une n\u00e9gociation efficace<\/span><\/b><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/h3><p><span data-contrast=\"auto\">L\u2019objectif d\u2019une n\u00e9gociation est toujours de retenir une offre am\u00e9lior\u00e9e. Dans une proc\u00e9dure de n\u00e9gociation, il est d\u00e8s lors vivement recommand\u00e9 de r\u00e9diger \u00e0 l\u2019avance un document reprenant les directives du contenu attendu des offres am\u00e9lior\u00e9es \u00e0 la lumi\u00e8re du crit\u00e8re concern\u00e9. Il peut s\u2019agir du prix, mais aussi d\u2019autres crit\u00e8res. Ce document devra bien s\u00fbr, toujours selon le principe d\u2019\u00e9galit\u00e9, \u00eatre communiqu\u00e9 \u00e0 tous les soumissionnaires.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">On sera par ailleurs particuli\u00e8rement attentif au principe de confidentialit\u00e9 dans le cadre d\u2019une n\u00e9gociation de prix. Est-il par exemple permis de communiquer au soumissionnaire le prix des autres offres ?
